Watch Your Step: What to Do If Someone Slips and Falls on Your Property

Whether you own a home or manage a bustling business, keeping your property safe is always a top priority. But even with the most meticulous maintenance, accidents happen. A stray patch of ice, a freshly mopped floor, a spilled drink, or an uneven walkway can lead to a sudden slip and fall in the blink of an eye.

When an injury occurs on your premises, it’s completely natural to feel a wave of panic. However, handling the situation with a calm, structured, and proactive approach is essential for protecting the injured person and safeguarding your insurance coverage.

From a risk management and insurance perspective, here is exactly what you need to do immediately following a slip and fall incident.

1. Prioritize Medical Attention Immediately

Your absolute first responsibility is the health and safety of the person who fell. Never minimize the incident or assume they are “fine” just because they can stand up.

  • Assess and Assist: Ask the person if they are hurt and if they need medical assistance. If the injury appears severe, or if they are in significant pain, call 911 immediately.
  • Do Not Move Them Excessively: If they suspect a broken bone or a head, neck, or back injury, keep them still and comfortable until emergency medical professionals arrive.
  • Offer Care, Not Judgement: Ensure they are in a safe spot away from further danger, but do not attempt to diagnose the injury yourself.

2. Document the Scene Thoroughly

In the insurance world, documentation is everything. Memories fade and physical conditions change quickly, so gathering evidence immediately is crucial for a fair claims process.

  • Take Photos: Use your phone to take clear, well-lit photos of the exact spot where the fall occurred. Capture the conditions from multiple angles. Is there water on the floor? An uneven sidewalk crack? Missing signage? Debris? Take photos of the injured person’s footwear as well, as this often plays a role in claims investigations.
  • Gather Witness Information: If any employees, customers, or bystanders saw the incident (or saw the conditions immediately before or after), write down their names, phone numbers, and a brief statement of what they witnessed.
  • Preserve Video Footage: If your business or home has security cameras, immediately isolate and save the footage from that entire day. Do not risk the footage being overwritten by your system’s automated loop.
  • Write Down What Happened: Make sure that whoever from your home or business witnessed the fall writes down exactly what happened.  Please include the date, time, weather, what you saw and what anyone may have said or what you said during the incident.

3. Fill Out an Incident Report (For Businesses)

If the slip and fall happens at your place of business, you should have a standardized incident report form ready to fill out.

  • Stick to the Facts: Record the date, exact time, location, weather conditions, and a completely objective description of what happened.
  • Avoid Speculation: Do not guess what caused the fall or write down assumptions. Simply record what was observed and what the injured party stated.
  • Get Signatures: If possible, have the manager on duty and the injured person (if they are able and willing) review and sign the report. Give them a copy if requested, but keep the original for your permanent records.

4. Watch Your Words: Do Not Admit Fault

It is a natural human reaction to want to apologize immediately when someone gets hurt on your property. Phrases like, “I am so sorry, we should have fixed that step last week,” or “It’s entirely our fault, we’ll take care of everything,” come from a place of empathy, but they can create massive legal complications later.

  • Be Polite and Compassionate: You can absolutely show concern and offer help without accepting legal blame. Stick to phrases like, “Let’s get you taken care of,” or “We want to make sure you’re okay.”
  • Let the Process Work: Leave the official determination of liability to the insurance adjusters and legal professionals who will evaluate all the facts objectively.

5. Notify Your Insurance Agent Promptly

Do not wait to see if the person is going to file a lawsuit or demand payment before contacting your insurance provider. Delayed reporting is one of the most common reasons claims get complicated or denied.

  • For Homeowners: Report the incident to your homeowner’s insurance agent. Your policy likely includes Personal Liability Coverage (to protect you if you are sued) and Medical Payments to Others (which can pay for a guest’s minor medical bills directly, regardless of who was at fault). Your agent can explain to you the process and what to expect.
  • For Business Owners: Notify your insurance agent immediately. They will assign a claims adjuster to investigate the incident, review your documentation, and handle negotiations or legal defense if a formal claim is filed against your business.

Proactive Prevention: The Best Defense

The easiest slip and fall claim to manage is the one that never happens! You can drastically reduce your risk by staying vigilant:

  • Mop up spills the moment they happen and always use “Wet Floor” caution signs.
  • Keep walkways, stairs, and parking lots well-lit and clear of debris, cords, or clutter.
  • Maintain a strict log of when floors are swept, mopped, or salted during the winter months—this log can be an invaluable shield during an insurance investigation.
  • Keep an eye on rugs to make sure that they are kept even on the ground and that corners or parts of the rug(s) don’t have a ripple or corner up.

If an accident does happen on your property, remember to stay calm, focus on helping the injured person, and document the facts.
